How does the points licence work for companies?
1 October 2024 was an epoch-making date for all companies and workers, both in the construction and non-construction worlds, operating within temporary or mobile construction sites. On that occasion, in fact, pursuant to the new Article 27 of the Consolidated Safety Act, as amended by Article 29, paragraph 19 of Decree Law 19/2024 (‘PNRR Decree 4’), the compulsory points-based driving licence came into force. A new instrument established to ensure safety at construction sites and compliance with regulations.
The credit licence was introduced to improve safety at work by qualifying and monitoring compliance with health and safety regulations. It therefore represents an important innovation in the construction sector and is one of the measures envisaged by the government to combat accidents at work, an increasingly central issue in safety policies.
Who has to apply for a points licence
The points licence will be required for all Italian and foreign companies and self-employed workers operating on temporary or mobile construction sites. Companies based outside the European Union will have to present the necessary documentation to prove the equivalence of the licence issued in their country of origin, in accordance with Italian law.
Who is exempt from the points licence in construction
The points licence is compulsory for all companies operating in the construction sector, while persons
– who carry out mere supplies or services of an intellectual nature
– in possession of an equivalent document from another State
– in possession of the SOA qualification certificate, in a classification equal to or higher than III.

How to apply
The application for a driving licence can be submitted through the portal of Ispettorato nazionale del lavoro starting on 1 October. The request must be sent by the legal representative of the company or the self-employed worker, who must self-certify the possession of certain fundamental requirements, including registration with the Chamber of Commerce, possession of a valid Single Document of contributory regularity (Durc), and fulfilment of training obligations regarding safety at work.
Release modalities
Once the application is submitted, the points licence in construction will be issued automatically. While waiting for issue, it will still be possible to continue working. Some requirements, such as registration with the Chamber of Commerce or possession of a valid Durc, can be self-certified. Others, such as the fulfilment of training obligations and the designation of the safety manager (Rspp), will have to be confirmed by means of substitute declarations.
The suspension
The credit licence may be suspended for a maximum of 12 months in the event of serious accidents on the construction site (such as the death or permanent disability of one or more workers) caused by the gross negligence of the employer or his delegate. The suspension may be lifted if safety conditions on the worksite are restored. In the event of untruthful declarations in the application, the licence may be permanently revoked, but it will be possible to apply for a new one after 12 months.
How the credit licence works
The licence will be awarded an initial score of 30 credits, which can be increased to a maximum of 100 through the adoption of additional occupational health and safety measures. Activities that will earn credits include, for example, investment in additional training and the adoption of certified contractual standards.
An increase of 10 credits is foreseen at the time the licence is issued, with an additional one credit for each two years of activity without violations, up to a maximum of 20 credits. However, reaching the 100-credit ceiling will require at least 40 years of activity without violations.
Credits recovery
Recovery of up to a maximum of 15 credits will be possible if the company proves that it has completed the necessary safety training courses and taken measures to improve working conditions. The assessment will be carried out by a territorial commission composed of representatives of INL and INAIL.
