LEGAL OBLIGATIONS OF THE EMPLOYER, MANAGER, OR THEIR DELEGATE.

In Italy, during a severe INJURY CASE (lasting more than 40 days), the Public Prosecutor’s Office, and even before that, the entity responsible for overseeing workplace safety, verify the general protective, preventive, and safety measures that the “employer” has implemented to prevent and protect workers from accidents and whether they are correct, adequate, and sufficient in reducing accident risks.

In Italy, The Employer (and/or the manager) has, among other obligations outlined in Legislative Decree 81/08 , the following responsibilities:

Monitor and analyze events that have resulted in near misses or almost accidents. Analysis of Big Data and near misses.

Provide workers with tools and technologies that help reduce accident risk and facilitate work processes.

Conduct periodic market research to find increasingly advanced solutions to safeguard workers’ health.
